$5,000

You are $5,000 over the $250,000 threshold. The tax is 15% of the lesser of that amount and your contributions.

How Division 293 tax is worked out

  1. Income for Division 293: taxable income plus reportable fringe benefits and net investment losses.
  2. Add your concessional contributions: employer super, salary sacrifice and deductible personal contributions.
  3. If the total is over $250,000, take the lesser of the excess and your contributions.
  4. Division 293 tax is 15% of that amount.

Example (the ATO's own): income of $240,000 and $15,000 of contributions makes $255,000, which is $5,000 over the threshold. That is less than the contributions, so 15% applies to $5,000: $750 of Division 293 tax.

Division 293 and salary sacrifice

With Division 293, salary-sacrificed super is taxed at 30% instead of 15%. At these incomes the marginal income tax rate is 45%, so salary sacrifice usually still saves tax. Compare the numbers with the salary sacrifice calculator, check your room under the concessional contributions cap and see your bracket on the tax brackets page. To see what the extra tax does to your balance at retirement, run the superannuation calculator.

Division 293 is one of two extra charges at high incomes. The other is the Medicare levy surcharge if you have no private hospital cover. At the opposite end of the scale, the low income tax offset reduces tax on incomes under $66,667.
